Court Rules Wife Cannot Claim Nominee Status in Pension Payment Order While Husband is Alive
In a significant ruling, the Rajasthan High Court, Jaipur Bench, has dismissed a writ petition filed by Smt Santosh Pareek seeking the inclusion of her name as a nominee in her husband's Pension Payment Order (PPO) for family pension benefits. The judgment, delivered by Justice Ashok Kumar Jain on January 30, 2026, emphasized that the claim was premature as the husband, Dr. Hari Mohan Sharma, is still alive.
The petitioner, represented by advocates Mr. Sunil Samdaria and Mr. Arihant Samdaria, argued that as the legally wedded wife, she should be included as a nominee for the family pension under the Rajasthan Civil Services (Pension) Rules, 1996. The rules define the "family" to include the wife of a male government servant. Despite matrimonial disputes and an unsuccessful divorce proceeding against her, the petitioner contended her right to be nominated for family pension benefits.
However, the respondents, represented by Mr. Archit Bohra, AGC, and Ms. Sweekriti Sharma, countered that the claim was not maintainable while Dr. Sharma is alive. They argued that the petition was filed prematurely, as the pension is considered the self-acquired property of the pensioner, who has full discretion over it during their lifetime.
The court, upon reviewing the arguments and relevant statutory provisions, held that the pension is indeed a self-acquired benefit earned by the individual through personal service and contributions. Thus, the petitioner has no current right to demand her name be included in the PPO as a nominee. The court ruled that the petitioner could raise her claim for family pension only after the death of the husband, and not while he remains alive.
The writ petition was dismissed, with the court stating that no order as to costs would be made. The judgment underscores the principle that self-acquired pension benefits are under the discretion of the pensioner during their lifetime, and claims for family pension rights can only be pursued posthumously.
