Court Upholds "Beldar" as Unskilled Labor and Advocates for 30-Day Wage Calculation Instead of 26 Days
In a landmark judgment, the Rajasthan High Court's Jaipur Bench, presided over by Justice Anoop Kumar Dhand, has ruled in favor of enhancing compensation for a motor accident victim, Laxman Kumawat, who was previously awarded an amount based on outdated wage calculations. The court has not only increased the compensation but has also urged the Ministry of Labour and the Rajasthan Government to amend their labor notifications to calculate daily wagers' income over 30 days instead of 26, thus aligning with the actual working conditions of daily laborers.
The case arose from a motor vehicle accident that occurred on August 27, 2020, where the claimant, Laxman Kumawat, sustained significant injuries, resulting in a 13% permanent disability. Initially, the Motor Accident Claims Tribunal categorized Kumawat, who worked as a "Beldar," as an unskilled laborer and calculated his monthly income based on a 26-day work month, awarding him Rs. 2,87,625/- in compensation.
Challenging this decision, the claimant argued that his occupation should be considered skilled labor and that his monthly income should reflect a 30-day work month. However, the High Court upheld the Tribunal's classification of "Beldar" as unskilled labor, referencing various notifications from labor authorities that clearly categorize "Beldar" as unskilled due to the lack of specialized skills or training required for the role.
The Court, however, found merit in the claimant's argument regarding the wage calculation. Justice Dhand emphasized that daily wage earners, who often work without guaranteed weekly holidays, should have their incomes calculated over a 30-day month to reflect their continuous work patterns. The judgment pointed out the financial hardships faced by daily wagers who are not compensated for rest days, despite labor laws mandating weekly offs.
Following this reasoning, the Court enhanced the compensation to Rs. 3,20,665.60, awarding an additional Rs. 33,040.60 to the claimant. The respondents were directed to deposit this enhanced amount into the claimant's bank account within two months, with an interest rate of 6% per annum from the date of filing the claim petition.
In a significant move, the Court also directed the Ministry of Labour and the Rajasthan Government to revise their notifications and circulars to adopt a 30-day wage calculation model for daily wagers, recognizing the economic realities faced by this labor segment. This directive aims to provide a more accurate reflection of the earnings potential and financial security of daily wage workers.
This judgment not only serves as a financial relief to the claimant but also sets a precedent for future compensation claims involving daily wage earners. It highlights the need for labor law reforms to better protect and support the livelihoods of unskilled workers across India.
