Court Directs Authorities for Swift Action on Repatriation of Deceased Indian Citizen's Remains


In a significant judgment, the Rajasthan High Court has directed the authorities to expedite the process of repatriating the mortal remains of an Indian citizen who passed away in Saudi Arabia. The order comes in response to a petition filed by Teejo Devi, whose son, working in Saudi Arabia, died on November 13, 2025. The court emphasized the need for a swift resolution to the bureaucratic and investigative delays that have hindered the repatriation process.


The petitioner, represented by Mr. Sushil Bishnoi, highlighted the distress caused by the delay, as the family awaits the return of their loved one’s remains. The last communication from Saudi authorities indicated an ongoing investigation to determine the cause of death, reported as an alleged suicide. The Court, presided over by Dr. Nupur Bhati, J., acknowledged the importance of completing necessary formalities but stressed the urgency required in such sensitive matters.


The learned Additional Solicitor General (ASG), Mr. Bharat Vyas, assisted by Mr. Vaibhav Bhansali, assured the court of active efforts by the authorities to expedite the investigation and repatriation. An email from the Community Welfare, Embassy of India in Riyadh, was presented, confirming the ongoing efforts to resolve the matter.


To further expedite the process, the court has issued notices to the Counsellor, Head of Consular Division, Embassy of the Kingdom of Saudi Arabia in New Delhi, and other relevant respondents. The Registrar (Judicial) has been directed to ensure swift communication of the court's directives to the concerned authorities via email.


The case has been scheduled for further hearing on December 17, 2025, with instructions for the respondents to provide complete updates and facilitate the repatriation process. This decision underscores the court's commitment to upholding the rights and dignity of Indian citizens abroad and ensuring timely justice for their families.
