In a significant ruling by the Rajasthan High Court, a habeas corpus petition concerning the well-being of a minor girl has been resolved with the court directing that the child remain in a Children's Home until she reaches the age of majority. The decision was based on the minor's mental state, her voluntary statements, and a report by counsellors.
The case, titled "Rameshwar v. State of Rajasthan," involved a petition by the girl's father, Rameshwar, who claimed that his daughter, referred to as Mst. 'G', was in the illegal detention of a third party. The court, however, found that the minor had left her home voluntarily due to alleged illegal activities by her father and did not want to return to her parental home.
During the proceedings, the court engaged directly with Mst. 'G', who reiterated her desire to remain at the Children's Home, citing fears of potential torture if she returned to her family. The court noted that her mental state was unstable, warranting her initial stay at the Children's Home, Chanderia, for counselling.
Upon reviewing the counsellors' report, the court concluded that Mst. 'G' should continue her stay at the Children's Home in Udaipur until she turns eighteen. At that point, she will be free to choose where she wishes to reside.
The court has also mandated the Secretary of the District Legal Services Authority in Udaipur to monitor the minor's well-being. Regular visits to the Children's Home are to be conducted at least once every two months to ensure her proper care.
The habeas corpus petition was thereby disposed of, with directions for a copy of the order to be sent to the relevant legal authority for compliance.
