In a significant judgment, the Rajasthan High Court, Jaipur Bench, quashed the criminal proceedings against Rajeev Dutta, an Enforcement Officer of the Jaipur Development Authority (JDA), citing the absence of requisite sanction under Section 197 of the Criminal Procedure Code (Cr.P.C.). The decision, delivered by Justice Pramil Kumar Mathur, highlights the mandatory requirement of prior sanction for prosecuting public servants when acts are connected to their official duties.


The case stemmed from a 2002 incident where Dutta allegedly directed the demolition of property as part of an anti-encroachment drive, leading to a police complaint and subsequent FIR under various IPC sections. Although a negative final report was initially submitted, a protest petition led to the Magistrate taking cognizance against Dutta in 2009, a decision upheld by a revisional court in 2018.


Dutta’s counsel argued that the actions taken were in the discharge of official duties and protected under the Cr.P.C. and the Jaipur Development Authority Act, 1982. The court agreed, referencing the statutory protections provided to public servants, emphasizing that the acts were connected to official functions and undertaken in good faith. The court noted that the cognizance without prior sanction from the competent authority was unlawful and amounted to an abuse of legal process.


This judgment underscores the judicial safeguards for public servants, ensuring they are not subjected to unwarranted legal proceedings for actions within their official capacity unless sanctioned by the government.
