Court affirms procedural lapses in enhancement of punishment by appellate authority under Rajasthan State Electricity Board Regulations.


In a significant ruling, the Rajasthan High Court has set aside the enhanced penalty imposed on Sunil Kumar Yadav, a Junior Engineer with the Jaipur Vidyut Vitran Nigam Limited, by the appellate authority. The court found that the enhancement of punishment from stoppage of one annual grade increment to two increments was done without adhering to the necessary procedural safeguards as outlined in Regulation 16 of the Rajasthan State Electricity Board Employees (Classification, Control & Appeal) Regulations, 1962.


The case arose from allegations against Yadav concerning the non-deposition of 383 burnt transformers and the associated oil during his tenure at the Office of O&M, Malakhera. Despite Yadav's contention that all materials were deposited within the stipulated time, the disciplinary authority had initially imposed a penalty of stopping one annual grade increment. Dissatisfied, Yadav appealed the decision, only to face an enhanced penalty from the appellate authority.


Presiding over the matter, Justice Munnuri Laxman emphasized that while the appellate authority possesses the power to enhance penalties, such actions must conform to procedural requirements. Regulation 16 mandates that before any enhancement, the authority must take suo moto cognizance, notify the concerned employee, and provide an opportunity for representation. The absence of these steps rendered the appellate decision unsustainable.


The court, however, upheld the findings of both the disciplinary and appellate authorities regarding the charges against Yadav, noting the lack of procedural irregularities in the initial proceedings. Consequently, while the enhanced penalty was quashed, the original penalty imposed by the disciplinary authority was confirmed.


The judgment underscores the importance of procedural compliance in disciplinary proceedings, particularly when appellate authorities seek to modify penalties. Legal experts view this decision as a reinforcement of employee rights and procedural fairness in administrative actions.
