Court Remands Case for Fresh Consideration, Highlights Need for Reasoned Decisions in Suspension Cases


In a significant ruling, the Rajasthan High Court, Jaipur Bench, has set aside an order by the Rajasthan State Road Transport Corporation (RSRTC) regarding the suspension of a petitioner, Pradeep Gupta, citing the absence of a reasoned order in the decision-making process. The court, presided over by Justice Ashok Kumar Jain, emphasized the importance of providing clear reasons when an authority makes decisions that adversely affect parties involved.


The case, filed as S.B. Civil Writ Petition No. 5490 of 2026, was decided on March 27, 2026. Pradeep Gupta had challenged the RSRTC's decision, which was based solely on the justification of suspension without detailing the reasons, as mandated by a previous court order dated November 27, 2025. The Executive Officer (Traffic) had dismissed Gupta's representation without adequately considering the legal precedents cited, leading the court to describe it as a reflection of "brain drain" within the RSRTC.


The court drew from previous judgments, including Ajay Kumar Choudhary v. Union of India and Parbat Singh v. The Rajasthan State Road Transport Corporation, to underline the necessity of a reasoned order. Justice Jain noted that the absence of reasons in the RSRTC’s decision rendered it unsustainable, thus necessitating its reconsideration by the Managing Director of RSRTC.


Additionally, the court directed the Principal Secretary, Department of Personnel, to ensure that Dr. Jyoti Chauhan, the Executive Director (Traffic), receives adequate training on procedural and legal principles before undertaking any human resource management duties within the corporation. This directive aims to prevent further procedural lapses.


The ruling reiterates the court's stance that decisions impacting individuals must be transparent and well-reasoned, linking the decision-maker's rationale to the issue at hand. The court's decision mandates a fresh review of Gupta's representation by the RSRTC's Managing Director, as per the order dated November 27, 2025.


The judgment serves as a reminder to administrative bodies to adhere to procedural fairness, ensuring that their decisions are not only justified but also clearly communicated to the affected parties.
