Court Rules Suspension Lacks Statutory Foundation; Orders Reinstatement
In a significant ruling, the Rajasthan High Court has quashed the suspension of Lal Singh Chouhan, a Teacher Grade-III, who was suspended by the District Education Officer (Headquarters), Elementary Education, Banswara, for allegedly making inappropriate comments on social media. The court found that the suspension order lacked the necessary statutory backing and was issued without proper jurisdiction.
Justice Farjand Ali delivered the judgment, emphasizing that suspension must strictly adhere to statutory provisions and cannot be based on arbitrary or subjective administrative satisfaction. The court observed that the impugned suspension order did not mention any statutory provision under which the power was exercised, and the District Education Officer was not the competent authority under Rule 13 of the Rajasthan Civil Services (Classification, Control and Appeal) Rules, 1958.
The controversy arose when Chouhan was accused of making comments on WhatsApp that allegedly tarnished the image of a concerned Minister. The court noted that while such allegations might warrant a departmental inquiry, they do not justify suspension without statutory authority. The ruling underscores the principle that administrative actions affecting civil consequences must be rooted in statutory provisions.
The court directed the reinstatement of Chouhan with all consequential benefits, highlighting the importance of legal discipline in administrative actions. It further clarified that any ongoing inquiry should proceed in accordance with established legal procedures.
The judgment serves as a reminder of the importance of adhering to legal frameworks in disciplinary actions within government services, reinforcing the rule of law in administrative decisions.
Bottom line:-
Suspension of government servant must strictly adhere to statutory provisions, and cannot be based on arbitrary or subjective administrative satisfaction.
