The judgment, delivered by Justice Anoop Kumar Dhand, addressed a petition by Pooranmal Yadav, who challenged the decisions of the Additional Sessions Judge, Chomu, District Jaipur, in Sessions Case No. 2/2024.
The petitioner was unable to cross-examine prosecution witnesses due to his counsel’s illness on the scheduled date. Despite submitting a written application for an adjournment, the trial court dismissed the request, closing the opportunity for cross-examination. Subsequent efforts to recall the witnesses under Section 311 of the Criminal Procedure Code (CrPC) were also denied by the trial court.
