Rajasthan High Court Upholds Apportionment of Liability in 2011 Motor Accident Case

Tribunal's Decision on Composite Negligence and Enhanced Compensation Affirmed by Rajasthan HC


In a significant ruling, the Rajasthan High Court, Jaipur Bench, has upheld the Motor Accident Claims Tribunal's decision regarding a 2011 motor accident involving a Scorpio car and a stationary truck. The accident, which occurred on the Alwar-Bhiwadi Highway, resulted in the deaths of two individuals, Jagdish Prasad and Santosh Kumar Sharma, and serious injuries to three others. 


The Tribunal had earlier determined that the accident was due to the negligence of both the car and truck drivers, apportioning liability between the insurance companies of the vehicles at a 75:25 ratio. The United India Insurance Company, the insurer of the car, had contested this decision, arguing that the truck driver was solely at fault for parking the vehicle improperly on the highway without any warning indicators. 


Justice Sandeep Taneja, presiding over the appeals, meticulously analyzed the evidence, including the FIR, witness testimonies, and police reports. The court concluded that both drivers were negligent, supporting the Tribunal's apportionment of liability. The court also emphasized that in cases of composite negligence, claimants could seek full compensation from any of the negligent parties. 


Additionally, the court addressed the issue of the deceased's income determination for compensation purposes. It ruled that the highest income reflected in the deceased's last Income Tax Return should be considered, leading to an enhancement of the compensation amount by Rs.15,93,435. 


The court further clarified that for age determination, official documents like the driving license and PAN card were more reliable than the post-mortem report. The enhanced compensation amount was directed to be paid with interest from the date of the claim filing.


This decision reinforces the principles of composite negligence and underscores the importance of reliable documentary evidence in determining compensation in motor accident cases.
