Rajasthan High Court Upholds Government's Policy Shift in Scheme Execution

Court mandates employment continuity and pay protection for willing workers under new outsourcing scheme

In a significant judgment delivered by the Rajasthan High Court's Jaipur Bench, Justice Munnuri Laxman has upheld the government's decision to modify the execution of a service scheme, effectively terminating petitioners' employment under the old system. The judgment came in response to writ petitions filed by Manish Dotasara and others, challenging their termination after the government restructured its scheme for lab technician services.

The petitioners, previously employed as lab technicians through a manpower agency, contested the termination of their services following the government's policy change. The new scheme integrates both infrastructure and manpower services under a single entity, eliminating the prior method of outsourcing manpower separately. This shift, according to the court, is a policy decision that cannot be reversed or interfered with, thus protecting the government's autonomy in policy formulation.

Justice Laxman emphasized that while the court cannot compel the government to revert to the old outsourcing model, the respondents are obligated to ensure employment continuity for those willing to transition into the new scheme. Furthermore, pay protection must be upheld for these employees, aligning their compensation with similarly placed workers under the new framework.

The judgment also highlighted the government's assurance to absorb willing workers into the new system, thereby guaranteeing employment despite the procedural changes. The ruling underscores the court's stance on maintaining the integrity of policy decisions while safeguarding employment rights and benefits.

The decision reflects a delicate balance between respecting governmental policy shifts and protecting the workforce affected by such changes. It reinforces the principle that courts should not disrupt policy decisions unless they contravene legal or constitutional provisions.

Bottom line:-

Termination of employment due to a change in the scheme of execution of services cannot be interfered with by the Court if the new scheme is a policy decision. However, the respondents are obligated to ensure continuity of employment for willing workers under the new scheme and pay protection must be maintained for similarly placed employees.

The case, marked by its implications for service law and employment rights, sets a precedent for handling similar disputes arising from policy changes in government schemes. It ensures that while policy decisions remain within the government's prerogative, affected employees have a pathway to continuity and fair treatment under new systems.
