Rajasthan High Court Upholds Teacher's Termination for Immoral Conduct Towards Minor Student

Court Affirms Importance of Moral Conduct in Education and Upholds Disciplinary Action by Kendriya Vidyalaya Sangthan

The Rajasthan High Court, Jaipur Bench, has dismissed the writ petition filed by Yatendra Kumar Nagori, challenging his termination from the position of a primary teacher at Kendriya Vidyalaya Sangthan (KVS). The termination was based on allegations of immoral sexual misconduct with a minor student, which the court found to be substantiated through thorough inquiries.

The Division Bench, comprising Justices Vinit Kumar Mathur and Ravi Chirania, rendered the decision on November 27, 2025, affirming the disciplinary action taken by KVS as justified and in compliance with the principles of natural justice. The court emphasized the critical role of teachers in shaping young minds and the necessity of upholding high moral standards in the teaching profession.

The allegations against Nagori arose from a complaint lodged on February 6, 2015, regarding his inappropriate behavior with a student from Class VI. Following an initial investigation and a detailed inquiry, the charges were confirmed, leading to Nagori's suspension and subsequent termination. Despite the petitioner's arguments claiming false implication and procedural lapses, the court found no merit in these claims.

The court highlighted the credibility of the victim's statements, noting that minor contradictions did not undermine the overall reliability of her testimony. It further emphasized that the inquiry process adhered to Article 81(B) of the Education Code of Kendriya Vidyalaya, ensuring the petitioner was given ample opportunity to defend himself.

In its judgment, the court also reiterated guidelines for judicial officers to avoid disclosing the names of minor victims in such cases, safeguarding their identities.

The ruling underscores the judiciary's commitment to maintaining ethical standards within educational institutions and reinforces the consequences of misconduct by educators.

Bottom Line:

Termination of a teacher from service due to allegations of immoral sexual misconduct with a minor student upheld by the court, emphasizing the significance of maintaining moral conduct in the teaching profession and adherence to natural justice principles.
