Supreme Court Upholds Promotions Under Tamil Nadu Municipal Corporation Service Rules, Long-standing promotions and seniority positions validated; challenges dismissed as fence-sitting claims


In a significant ruling, the Supreme Court of India has upheld the validity of promotions granted under the Tamil Nadu Municipal Corporation Service Rules, 1996, settling a long-standing dispute over seniority and promotions within the Coimbatore City Municipal Corporation. The judgment was delivered by the bench comprising Justices R. Mahadevan and Ahsanuddin Amanullah.


The appeals arose from disputes surrounding the promotions of T. Gnanavel, originally appointed as a Fitter in 1988 and subsequently promoted through various ranks to Executive Engineer, and R. Sasipriya, who challenged the seniority list placing her below Gnanavel. The controversy began when the Tamil Nadu government issued G.O. (D) No. 19 in 2005, promoting Gnanavel as Assistant Engineer with notional effect from 1997, which was contested by Sasipriya. The Division Bench of the Madras High Court had earlier set aside this government order, prompting the appeals.


The Supreme Court overturned the High Court's decision, reinstating the government order and confirming the subsequent promotions of Gnanavel. The Court emphasized that interference with long-settled promotions after nearly two decades would be unjust and would disrupt established service positions. The bench noted that the promotions were granted in compliance with government orders and judicial directions and found no irregularities warranting judicial interference.


Moreover, the Court dismissed the claims of impleading applicants as fence-sitters, underscoring that individuals cannot challenge settled matters of seniority and promotions after significant delay, citing principles of delay, laches, and constructive res judicata. The Court's decision brings closure to the protracted litigation, affirming the government's policy decisions in restructuring the municipal corporation's service rules and promoting qualified individuals in line with those rules.


This ruling not only reinforces the legitimacy of the government’s administrative decisions but also provides clarity on the application of service rules in municipal corporations, impacting numerous employees across Tamil Nadu.
