Madras High Court Upholds Constitutional Rights, Calls for Legal Action Against Caste-Based Discrimination at Arulmigu Mariamman Temple

In a significant judgment dated September 17, 2025, the Madurai Bench of the Madras High Court, under Justice B. Pugalendhi, has underscored the constitutional right to equality in worship, directing authorities to ensure Scheduled Caste devotees are granted access to the Arulmigu Mariamman Temple in Chinna Dharapuram, Karur District. The Court's decision comes in response to petitions filed by Vanniyakulachathiriyar Nala Arakattalai and others, highlighting the persistent caste-based discrimination preventing temple entry.


The judgment draws upon historical struggles for temple access, including the Vaikom Satyagraha of 1924-25 and the Temple Entry Proclamation of 1936, reminding the nation of its commitment to abolishing untouchability and upholding equality as enshrined in Articles 14, 15, and 17 of the Indian Constitution. Justice Pugalendhi lamented that despite India's progress since these landmark moments, the judiciary remains compelled to intervene to uphold rights that should be guaranteed by authorities.


The Court expressed strong condemnation towards the District Collector and Superintendent of Police of Karur District for their failure to enforce fundamental rights and administrative responsibilities. The judgment criticized their inaction, labeling it as administrative cowardice and a betrayal of constitutional duties. The Court emphasized the necessity for peace meetings between communities and proactive measures to ensure uninterrupted worship, condemning the closure of the temple since 2018 due to apprehensions of disturbance.


Justice Pugalendhi directed the State Government to take corrective measures, including the possible replacement of current administrators, ensuring that constitutional values are upheld. The judgment underlined the importance of leadership in protecting rights, stating, "Officers who live off the fruits of the Constitution, but refuse to implement its commands, betray their oath."


Further, the Court addressed criminal actions obstructing temple entry, directing earnest pursuit of registered cases against individuals defying constitutional rights. Highlighting a criminal case registered at Chinnadhapuram Police Station, the Court ordered strict legal consequences to ensure equality in worship becomes non-negotiable.
