The judgment, delivered by Mrs. Meenakshi Madan Rai, J., emphasized the necessity of concrete evidence when determining disability and compensation claims.
The case involved Gyandup Tshering Lepcha, who, following a vehicular accident, was awarded compensation by the MACT after it assessed his disability at 50%. This assessment was made in the absence of a formal disability certificate or corroborative medical evidence. The appellant, The New India Assurance Company Limited, contested this decision, arguing that the compensation was grounded in unsubstantiated assumptions rather than factual evidence.
Upon review, the High Court found that the MACT's decision was indeed based on surmises, as the medical documents, including discharge summaries, did not support the claim of a 50% permanent disability. The Court noted that while the claimant had suffered serious injuries, including rib fractures and a dislocated hip joint, the medical reports indicated a recovery that did not align with the assessment of a substantial disability.
The Court concluded that without a disability certificate or detailed medical testimony indicating a loss of earning capacity, the compensation could not include loss of income. Consequently, it reduced the compensation to Rs. 1,14,147, the amount substantiated by medical bills for the claimant's treatment.
Moreover, the Court directed that this sum be paid by the insurance company with an interest of 9% per annum from the date of the filing of the claim petition, escalating to 12% if not paid within the stipulated time.
This judgment underscores the importance of evidence-based evaluations in compensation claims and sets a precedent in ensuring claims are substantiated by concrete proof of disability and financial loss.
