Court Emphasizes Need for Exceptional Circumstances and Proper Application for Interim Relief in Writ Petitions
In a significant judgment delivered on March 24, 2026, the Division Bench of the Sikkim High Court, comprising Chief Justice A. Muhamed Mustaque and Justice Bhaskar Raj Pradhan, has set aside interim orders directing compensation payments in writ petitions involving IRCON, International Ltd and the State of Sikkim. Liberty has been granted to the writ petitioner to approach the learned Single Judge with an appropriate application seeking interim relief or to push for the final disposal of the writ petition. The Bench acknowledged the urgency of the matter and encouraged swift resolution by the Single Judge, with the next hearing scheduled for March 31, 2026.
