The bench, comprising Justices Ahsanuddin Amanullah and N.V. Anjaria, has sought detailed affidavits from the Government of India, all State Governments and Union Territories, and the University Grants Commission (UGC). These affidavits are expected to cover a wide range of issues, including the statutory provisions under which these universities were established, the benefits granted to them, and their compliance with existing laws and policies.


The Court has expressed concerns over the financial transparency of these institutions, particularly those claiming to operate on a 'no profit, no loss' basis. It has called for information on the mechanisms in place to prevent the diversion of funds and ensure that financial practices are aligned with legal requirements.


Additionally, the Supreme Court has highlighted the importance of robust grievance redressal mechanisms for both students and staff. It has mandated that details of such mechanisms be included in the affidavits, alongside information on the payment of minimum salaries to faculty and staff as required by law.


The UGC has been specifically tasked with outlining its role in monitoring compliance by private universities, with a focus on admission policies, recruitment processes, and the enforcement of regulatory checks.


The Court's directive underscores its commitment to ensuring that private educational institutions operate with transparency and accountability, in line with statutory requirements. By demanding comprehensive disclosures from key stakeholders, the Supreme Court aims to uphold the integrity of the higher education system in India.


The next hearing in the case is scheduled for January 8, 2026, where the Court will review the affidavits submitted by the concerned parties. The Supreme Court has warned of strict action in case of any misrepresentation or suppression of facts in the affidavits, highlighting the gravity of the issue at hand.
