Judicial Officers' Safety Concerns Prompt Transfer of Probe from State Police to National Investigation Agency


In a landmark decision, the Supreme Court of India has mandated the National Investigation Agency (NIA) to assume responsibility for the investigation of several serious allegations against the State and local police in West Bengal. This decision, pronounced by a bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and Vipul M. Pancholi, arises from a suo motu writ petition concerning the safety and security of judicial officers engaged in electoral roll duties in West Bengal.


The case stems from incidents reported on April 1, 2026, where judicial officers were allegedly taken hostage. The Supreme Court, expressing grave concern over the safety of these officers, has directed the NIA to take over the investigation from the State Police, citing the need for an impartial and comprehensive inquiry. The Court's directive is backed by Article 142 of the Constitution of India, which allows it to pass necessary orders to ensure complete justice.


The Court's order comes in the wake of multiple FIRs registered at police stations in Malda and Kalichak, West Bengal, which include allegations of serious offenses under the Bharatiya Nyaya Sanhita, 2023, and other statutory provisions. The State Police has been instructed to hand over all investigation records to the NIA and provide logistical support to facilitate the probe.


Furthermore, the Supreme Court has emphasized the need for accountability and has directed the Chief Secretary and Director General of Police to cooperate fully with the Chief Justice of the High Court to ensure the safety of judicial officers. The NIA is expected to report its findings to the NIA Court in Kolkata and periodically update the Supreme Court on the investigation's progress.


The decision underscores the Supreme Court's commitment to upholding the rule of law and ensuring the safety of judicial officers, highlighting the judiciary's role in maintaining the integrity of electoral processes.
