Supreme Court Dismisses Jiostar India's Special Leave Petition Against Competition Commission

No grounds found to challenge High Court's order; all pending applications disposed of.

In a significant development, the Supreme Court of India has dismissed the Special Leave Petition filed by Jiostar India Private Limited against an order of the High Court, which involved the Competition Commission of India (CCI) as a respondent. The decision, rendered by a bench comprising Justices J.B. Pardiwala and Sandeep Mehta, upheld the High Court's ruling, finding no substantial grounds to warrant interference.

The petition, numbered 2867 of 2026, was deliberated upon by the Supreme Court on January 27, 2026. Representing Jiostar India, eminent legal luminaries such as Mr. Mukul Rohatgi and Mr. Maninder Singh argued the case, supported by a robust team of advocates. On the other side, the respondents, including the CCI, were represented by Mr. N. Venkataraman, Additional Solicitor General, along with Mr. Kapil Sibal and other distinguished advocates.

The court noted that after thoroughly examining the submissions and materials presented, there was an absence of compelling reasons to overturn the High Court's decision. Consequently, the Supreme Court decided not to interfere with the impugned order, leading to the dismissal of the Special Leave Petition. Furthermore, the court also ordered the disposal of any pending applications related to the petition.

This ruling reinforces the autonomy of the High Court's decisions concerning competition law matters and highlights the rigorous standards required for the Supreme Court to entertain appeals through Special Leave Petitions.

Bottom Line:

Special Leave Petition dismissed - No good ground found to interfere with the impugned order of the High Court.

Statutory provision(s): Special Leave Petition.
