Supreme Court Ensures Legal Aid for Voter List Exclusion Appeals

Interim Measures Directed for Timely Filing and Facilitation of Appeals by Excluded Voters


In a landmark interim order, the Supreme Court of India has addressed the urgent need to safeguard the right to appeal for approximately 3.66 lakh individuals excluded from the final voter list. The ruling, delivered by the bench comprising Justices Surya Kant and Joymalya Bagchi, mandates the deployment of para-legal volunteers and free legal aid counsels to assist affected individuals in filing statutory appeals.


The petition, brought forth by the Association For Democratic Reforms against the Election Commission of India, highlighted discrepancies in the exclusion process, contesting the Commission’s claim that all excluded individuals had been duly notified with reasons for their exclusion. With the statutory appeal period nearing its end, the Court has deemed it necessary to intervene to prevent any infringement of voting rights.


The Executive Chairman of the Bihar State Legal Services Authority has been tasked with coordinating with District Legal Services Authorities to mobilize para-legal volunteers across villages. These volunteers will be responsible for contacting Booth Level Officers to gather comprehensive data on excluded individuals, thereafter informing them of their appellate rights and facilitating the drafting of appeals. In addition, approved legal aid counsels will be on hand to ensure that appeals are filed within the stipulated limitation period.


The Supreme Court’s order extends similar facilitation to individuals whose names were absent from the draft voter list and who had unsuccessfully applied for inclusion. This inclusive directive underscores the Court’s commitment to ensuring electoral justice for all citizens.


The matter is scheduled for further hearing on October 16, 2025, where the Court will deliberate on issuing instructions to appellate authorities for timely and reasoned adjudication of appeals.
