Landmark Judgment Expands Rights Framework to All States and UTs, Calls for Comprehensive Compliance and Monitoring


In a significant ruling, the Supreme Court of India has issued directions aimed at enhancing the rights and welfare of prisoners with disabilities across the country. The judgment, delivered by the bench comprising Justices Vikram Nath and Sandeep Mehta, extends the framework established in the case of L. Muruganantham v. State of Tamil Nadu to all States and Union Territories, ensuring that the constitutional guarantees of dignity, equality, and non-discrimination are upheld within custodial settings.


The court has mandated comprehensive measures to identify prisoners with disabilities, provide accessible infrastructure, and ensure inclusive education and enhanced visitation rights. A High-Powered Committee has been entrusted with the oversight and implementation of these directives, ensuring that prison systems comply with the Rights of Persons with Disabilities Act, 2016, and adhere to constitutional safeguards.


The judgment arises from a writ petition filed by Sathyan Naravoor, wherein the court recognized the need for a robust grievance redressal mechanism and structured provision of assistive devices for prisoners with disabilities. The ruling emphasizes the humane treatment of such prisoners, mandating States and UTs to file compliance reports within stipulated periods, outlining measures undertaken to fulfill the court's directives.


Furthermore, the court has directed the Secretary of the Department of Empowerment of Persons with Disabilities and the Secretaries of Social Justice from all States and UTs to actively participate in the proceedings before the High-Powered Committee.
