Judgment Deems Officers as Having Completed 20 Years of Service; Ensures Transparency in Future Selection Boards
In a landmark judgment, the Supreme Court of India has ruled in favor of Short Service Commission Women Officers (SSCWOs) of the Indian Air Force, who were denied Permanent Commission (PC) based on arbitrary policy applications. The bench, comprising Chief Justice Surya Kant, Justice Ujjal Bhuyan, and Justice Nongmeikapam Kotiswar Singh, addressed the grievances of the SSCWOs who were denied PC due to the hasty implementation of new performance criteria under the Indian Air Force Human Resource Policy 01/2019. The court found that the criteria were introduced without providing the officers a reasonable opportunity to meet them, and the use of Annual Confidential Reports (ACRs) for evaluation, which were not designed to assess long-term career progression, was deemed unfair.
The judgment highlights several key issues, including the arbitrary imposition of new eligibility criteria, lack of transparency in vacancy computations, and unfair treatment of officers due to maternity leaves. The court directed the Air Force to issue clear instructions regarding vacancies, evaluation criteria, and marks apportionment for future Selection Boards to ensure fairness and transparency.
Although the court did not direct reinstatement for the officers released in 2021, it emphasized the importance of providing them with pensionary benefits. The judgment also allows for continued legal remedies for SSCWOs still in service under interim orders.
