Supreme Court invokes Article 142 to rectify discrimination faced by SSCWOs, breaches 250-vacancy cap for corrective relief.
In a landmark judgment dated March 24, 2026, the Supreme Court of India ruled in favor of granting Permanent Commission (PC) to women Short Service Commission Officers (SSCWOs) in the Indian Army, addressing systemic inequalities that have historically disadvantaged them. The judgment comes in response to appeals by 73 SSCWOs, whose grievances centered around unfair evaluation methods that impacted their career progression.
The bench, led by Chief Justice Surya Kant and Justices Ujjal Bhuyan and Nongmeikapam Kotiswar Singh, found that the evaluation regime, particularly the grading of Annual Confidential Reports (ACRs), was biased against women officers. The Court noted that these reports were often casually graded with the assumption that women officers had limited career progression due to their ineligibility for PC at the time of their commissioning.
Additionally, the judgment highlighted the lack of access to career-enhancing opportunities, such as criteria appointments and additional courses, which further skewed the comparative merit against SSCWOs. The Supreme Court observed that the annual cap of 250 vacancies for PC, historically breached during exigencies, could not be used as a shield against remedial actions addressing inequality.
The Court invoked Article 142 of the Constitution, granting relief to the affected women officers. It ordered that those SSCWOs who have fulfilled the minimum cut-off grade of 60% are entitled to PC, subject to meeting medical and disciplinary criteria. Those released from service are deemed to have completed 20 years of service, making them eligible for pension and benefits, albeit without arrears of pay.
The judgment rejected the claims of male Short Service Commission Officers (SSCOs) who argued for exclusive male consideration for PC, affirming that legitimate expectation must align with constitutional mandates of gender equality.
This decision marks a significant step towards gender parity in the Indian Armed Forces, ensuring that women officers receive fair and equal treatment in their service evaluations and career advancements.
Bottom Line:
Women Short Service Commission Officers (SSCWOs) are entitled to Permanent Commission (PC) in the Indian Army. Systemic inequality, casual grading of Annual Confidential Reports (ACRs), and lack of access to career-enhancing opportunities have adversely impacted their merit position, requiring corrective relief under Article 142 of the Constitution.
