Enforces Vehicle Location Tracking and Speed Limiting to Enhance Road Safety Across India


In a landmark decision aimed at bolstering road safety, the Supreme Court of India, on May 13, 2026, directed all States and Union Territories to strictly enforce the installation of Vehicle Location Tracking Devices (VLTD) and Speed Limiting Devices (SLDs) in public service vehicles. The verdict, delivered by Justices J.B. Pardiwala and K.V. Viswanathan, underscores the Court's commitment to ensuring passenger safety and reducing road accidents across the country.


The Court's directives stem from a writ petition filed by S. Rajaseekaran, emphasizing the urgent need for regulatory measures to enhance public transportation safety. The judgment mandates that no public service vehicle should be granted a fitness certificate or a permit without the verified installation of VLTD and emergency buttons, reflecting these in the Vahan database for real-time compliance monitoring. This includes retrofitting vehicles registered before December 31, 2018.


Highlighting the critical role of VLTDs, the Court noted their capability to provide real-time location monitoring, integrated emergency response through panic buttons, and route deviation alerts, thereby ensuring swift action during emergencies. The judgment also emphasized the importance of manufacturers providing pre-fitted VLTDs in new vehicles, urging the Union Government to facilitate discussions with vehicle manufacturers to implement this measure.


In addition to VLTDs, the Court addressed the enforcement of Speed Limiting Devices under Rule 118 of the Central Motor Vehicles Rules, 1989. It directed States to ensure manufacturers pre-fit SLDs in transport vehicles, integrating this with the Vahan database to monitor compliance. The judgment called for quarterly compliance reports from States, detailing SLD installations and adherence to safety norms.


The Supreme Court further pressed the Union of India to expedite the constitution of the National Road Safety Board, granting a final three-month window to establish this pivotal body. The Board is expected to play a crucial role in governance and policymaking related to road safety measures.


In a broader context, the judgment also addressed pedestrian safety, directing road-owning agencies and the National Highways Authority of India (NHAI) to prioritize pedestrian crossings and foot overbridges in high-risk areas, with a phased implementation plan across 50 cities.


This comprehensive judgment is a significant step forward in India's road safety efforts, reflecting the judiciary's proactive stance in safeguarding public welfare on the nation's roads.
