Supreme Court Mandates Special Investigation Team to Probe Insurance Fraud Allegations

Insurance Companies Directed to Report Forged Policies; National Insurance Ordered to Deposit Compensation Amid Fraud Claims


In a landmark decision dated April 2, 2026, the Supreme Court of India directed the formation of a Special Investigation Team (SIT) to investigate allegations of forgery and fabrication concerning an insurance policy. The case involves National Insurance Company Limited and respondent K. Saravanan, among others. The Court emphasized the legal obligation of insurance companies to report any instances of forged or fabricated policies to the police, highlighting that failure to do so could imply possible connivance.


The bench, comprising Justices Ahsanuddin Amanullah and R. Mahadevan, criticized the casual approach of National Insurance Company for its failure to report the alleged fraudulent policy to the authorities. The Court directed the Director General of Police (DGP), Tamil Nadu, to ensure an expeditious and thorough investigation by the SIT, including the insurance company's officers and other responsible parties.


The judgment also reiterated the principle that allegations of fraud must be substantiated with specific evidence, drawing from the precedent set in Bishnudeo Narain v. Seogeni Rai, 1951. The Court noted that the burden of proof lies with the party alleging fraud.


Additionally, the Supreme Court ordered National Insurance Company to deposit the compensation amount as directed by the High Court within four weeks. The company is granted the liberty to recover the amount from the responsible respondent. The ruling underscores the Court's commitment to ensuring that insurance companies act with due diligence and accountability, especially when dealing with public funds contributed by policyholders.


The DGP of Tamil Nadu has been directed to implement systems to ensure investigating officers can readily access insurance details via a centralized portal, enhancing the efficiency and reliability of investigations involving insurance claims.


The case is set to be reviewed again on April 28, 2026, with a status report to be submitted by the State of Tamil Nadu.
