Apex Court Criticizes High Court for Inaction, Directs Investigation to Ensure Judicial Accountability


In a significant ruling, the Supreme Court of India has directed the lodging of a First Information Report (FIR) and a thorough investigation into the mysterious disappearance of original court documents, emphasizing the need for judicial accountability. The case, titled Anwar Begum Mahemoodmiya Chisti v. State of Gujarat, arose from the appellants' grievance over the High Court's failure to address the issue of missing documents, which were crucial to their defense in an ongoing civil suit.


The appellants, represented by Senior Advocate Mrs. Kawaljit Kochar, argued that the original documents, presented by the plaintiff in Civil Suit No. 19/2008 before the Senior Civil Judge in Kalol, Gujarat, were pivotal to proving their case. These documents allegedly went missing after a request was made to send them for forensic examination to verify their authenticity. The absence of these documents severely undermined the appellants' defense, which hinged on proving that the receipts were forged.


Despite a preliminary inquiry identifying certain court personnel as responsible, disciplinary proceedings concluded without holding anyone accountable. The High Court's inaction in this matter drew sharp criticism from the Supreme Court, which highlighted the seriousness of losing original court documents and the resultant lack of institutional accountability.


The Supreme Court, comprising Justices Ahsanuddin Amanullah and R. Mahadevan, expressed surprise at the High Court's failure to direct an FIR, considering the gravity of the situation. The bench noted that the preliminary inquiry report, dated November 19, 2014, clearly pointed to individuals responsible for the disappearance of the documents.


In its order, the Supreme Court set aside the High Court's decision, directing the Registrar of the concerned District Court to file an FIR with the District Police. The Court emphasized the necessity for a comprehensive and prompt investigation, instructing both the High Court and the District Court to fully cooperate with the investigative process.


The Supreme Court's decision underscores the critical need for maintaining the integrity of judicial processes and ensuring accountability within the judiciary. The ruling is expected to serve as a deterrent to administrative lapses and reinforce the importance of safeguarding court records.
