Supreme Court Quashes Prosecution of IAS Officer for Arms License Irregularities
Sanction Order and Delayed Investigation Rendered Invalid in Supreme Court's Ruling
In a significant ruling, the Supreme Court of India quashed the prosecution against Robert Lalchungnunga Chongthu, an Indian Administrative Services officer, in a case concerning irregular issuance of arms licenses. The judgment delivered by the bench comprising Justices Sanjay Karol and Nongmeikapam Kotiswar Singh highlighted critical lapses, including the invalidity of the sanction order and an unjustified delay in investigation spanning over a decade.
The case, which originated over twenty years ago, involved allegations against Chongthu for issuing arms licenses without proper police verification during his tenure as District Magistrate-cum-Licensing Authority in Sahasra, Bihar. The Supreme Court scrutinized the procedural integrity of the sanction granted under Section 197 of the Criminal Procedure Code (CrPC) and found it to be a non-speaking order lacking application of mind by the sanctioning authority.
Furthermore, the court addressed the excessive delay in the investigation process, which took more than 11 years to culminate in a chargesheet, emphasizing that such delays violate the right to a speedy trial under Article 21 of the Constitution. The judgment underscored the necessity for timely investigations and highlighted that the absence of a reasonable explanation for the delay invalidated the prosecution.
The court also issued directions to ensure judicial oversight in cases of further investigation and emphasized the importance of providing reasons in sanction orders to safeguard against arbitrary prosecutions. The ruling reaffirms the principles of fairness and accountability in the criminal justice process, setting a precedent for future cases involving public servants.
