The Court addressed a miscellaneous application filed by the Rajasthan Public Service Commission (RPSC) seeking modification of an earlier order that allowed provisional participation in a recruitment examination.
The original order, dated April 2, 2026, permitted Surajmal Meena to participate in the upcoming recruitment examination scheduled for April 5, 2026, provisionally and without creating any equity. It also included a provision allowing other similarly placed candidates to be granted provisional participation. However, RPSC raised concerns about logistical challenges associated with extending this benefit to all potential candidates within the limited time frame.
Upon reviewing the logistical difficulties presented by RPSC, the Supreme Court decided to modify its previous order. The Court acknowledged the practical constraints in issuing admit cards to numerous aspirants on such short notice and thus restricted the provisional participation exclusively to Surajmal Meena. The Court directed the deletion of certain paragraphs from the original order and specifically modified another paragraph to apply solely to Meena.
The judgment further clarified that the ongoing appeals before the Division Bench of the High Court of Rajasthan, Jaipur Bench, remain unaffected by this order. The Supreme Court emphasized that the decision was made without prejudice to the rights and contentions of parties in the High Court proceedings. It also noted that should the High Court direct RPSC to conduct a further examination, private parties might benefit, and any aggrieved parties may seek legal remedies accordingly.
The application by RPSC has thus been disposed of with these modifications, ensuring that the provisional participation in the recruitment examination remains limited to Meena, thereby averting logistical challenges for the Commission.
