Apex Court Directs Senior Counsel to Submit Brief Note on Issues Raised Against Union of India


In a significant development, the Supreme Court of India has taken steps to address concerns raised by the Federation of Medical and Sales Representatives Associations of India in a public interest litigation (PIL) against the Union of India and other respondents. The matter, registered as Writ Petition(s)(Civil) No(s). 323 of 2021 and W.P.(C) No. 794 of 2023, was heard by a bench comprising Justices Vikram Nath and Sandeep Mehta.


The court directed Mr. Sanjay Parikh, the learned senior counsel representing the petitioners, to provide a brief note within three days, outlining the suggestions forming the basis of his arguments. This note is to be shared with other senior counsels, including Mr. K.M. Nataraj, Mr. Kapil Sibal, and Mr. Kavin Gulati, who are representing the respondents.


Furthermore, Mr. K.M. Nataraj, the Additional Solicitor General appearing for the Union of India, has been given three weeks to obtain necessary instructions. The court has also allowed other respondents the opportunity to file their responses to the submissions already made.


The PIL, which raises various issues concerning the medical representatives and their engagement with the Union of India, seeks to address systemic problems and improve the conditions for those in the field. The court's directive is part of its efforts to ensure a comprehensive understanding and resolution of the issues presented.


Mr. Kaleeswaram Raj, another learned counsel in the matter, has been instructed to send his suggestions within three days to Mr. Nataraj and other counsel representing the respondents.


The Supreme Court has scheduled the next hearing for 16th December 2025, with the matter being listed high on the board immediately after fresh matters are addressed. This approach underscores the court's commitment to addressing the grievances raised by the Federation and ensuring that a thorough examination of the issues is conducted.
