Supreme Court dismisses appeals challenging the invalidation of selection for Computer Hardware Engineer in Himachal Pradesh due to non-fulfillment of essential qualifications.


In a landmark judgment, the Supreme Court of India has reinforced the need for strict adherence to eligibility criteria in public employment, emphasizing that higher academic qualifications cannot compensate for the lack of essential experience. The apex court upheld the decision of the Himachal Pradesh High Court, which had invalidated the selection process for the post of Computer Hardware Engineer in the Himachal Pradesh Board of School Education.


The case involved a recruitment process initiated by the Board, which stipulated a minimum of five years' work experience as an essential qualification. The appellant, Himakshi, was initially selected for the post despite having only one year of relevant experience, on the grounds of possessing a higher qualification, an M.Tech degree. The Supreme Court, however, ruled that essential qualifications such as work experience cannot be overridden by academic achievements.


The Court further highlighted that any relaxation of eligibility criteria must be exercised consciously and with documented reasons, which was not the case in the selection of Himakshi. The judgment noted that the selection committee failed to record any decision regarding the relaxation of the experience requirement, rendering the process arbitrary and unsustainable.


The Supreme Court's decision also addressed the issue of equity in public employment, stating that long service or equitable considerations cannot justify appointments made without fulfilling minimum qualifications. The Court emphasized that participation in a selection process does not confer an automatic right to appointment, particularly when the process is flawed.


While the Court acknowledged that Himakshi had served in the position for a considerable period and was regularized in service, it maintained that such factors do not outweigh the need for compliance with eligibility criteria. The Court did not grant any appointment to the unsuccessful candidate Rahul, as the selection process itself was found to be vitiated.


The Supreme Court's ruling underscores the importance of maintaining transparency and adherence to declared criteria in public sector recruitments, ensuring that all candidates are judged fairly based on the established rules and qualifications.
