Telangana High Court Addresses Citizenship Dilemma for Pakistani National Born in India

Court Impleads Passport Authorities to Resolve Status of Resident Without Long-term Visa

In a pivotal judgment, the Telangana High Court has addressed the complex issue surrounding Syed Ali Hussain Razvi, a Pakistani national born in India, who is residing in Hyderabad without a long-term visa. The court has allowed the inclusion of passport authorities as respondents in the ongoing legal proceedings to assess the citizenship status and resolve documentation challenges faced by Razvi.

The case, Syed Ali Hussain Razvi v. State of Telangana, highlights the intricate legal scenario where Razvi, born in India to a Pakistani mother who later remarried an Indian citizen, possesses crucial identity documents such as Aadhar Card, Voter ID, Pan Card, Driving License, and School Certificates, but lacks an Indian passport. Despite these Indian identity proofs, his lack of a long-term visa has subjected him to domiciliary visits by the Special Branch Police, overseeing cases of Pakistani nationals.

Razvi's mother, originally an Indian citizen, moved to India after divorcing her Pakistani husband and has been extending her long-term visa periodically. However, Razvi has never applied for a long-term visa or an Indian passport, complicating his legal standing in India. This predicament led Razvi to file a writ petition seeking legal protection against police visits and potential prosecution, which was dismissed by the writ court, prompting the current appeal.

In response to Razvi's appeal, the Telangana High Court has permitted the impleadment of passport authorities to aid in resolving his citizenship dilemma. The court has directed that a copy of the writ appeal, along with annexures, be served to Mr. N. Bhujanga Rao, Deputy Solicitor General of India, by February 13, 2026. The matter is slated for further hearing on February 24, 2026, allowing both the government pleader for home and the Deputy Solicitor General to seek necessary instructions.

This judgment underscores the complexities of citizenship laws and the challenges faced by individuals born in India to foreign nationals, particularly in situations involving long-term visas and national identity documentation. The High Court's decision to involve passport authorities aims to find a legal resolution to Razvi’s situation, potentially setting a precedent for similar cases in the future.

Bottom Line:

Issue regarding the residence of a Pakistani national born in India, staying in India without a long-term visa, and the legal implications of his residence and documentation.
