Court mandates state-wide seniority for Telangana Special Police Battalions, aligning with Presidential Order.


In a landmark judgment delivered on February 17, 2026, the Telangana High Court, comprising Chief Justice Aparesh Kumar Singh and Justice G.M. Mohiuddin, ruled that battalion-wise seniority and promotions within the Telangana Special Police Battalions are unconstitutional. This decision mandates adherence to state-wide seniority as per the Andhra Pradesh Public Employment (Organisation of Local Cadres and Regulation of Direct Recruitment) Order, 1975, commonly referred to as the Presidential Order.


The case, S.P. Kasim Peera v. State of Telangana, was brought forward by petitioner S.P. Kasim Peera, an Assistant Reserve Sub-Inspector (ARSI), challenging the validity of Rule 3 of the Andhra Pradesh Police (Special Police Battalions) Subordinate Service Rules, 1997, and Rule 1(b) of G.O.Ms.No.85, 1997. These rules had allowed for promotions based on battalion-wise seniority, which the court found inconsistent with the Presidential Order's mandate for state-wide cadre posts.


The court's decision highlights the inconsistency of the 1997 rules with the constitutional framework, emphasizing that the Presidential Order has overriding statutory force. The ruling aligns with admissions by state authorities, including a 2017 communication from the Director General of Police, Telangana, acknowledging the rules' inconsistency with the Presidential Order.


Petitioner S.P. Kasim Peera argued that promotions based on battalion-level seniority denied him rightful consideration, contravening Articles 14, 15, and 21 of the Constitution of India. The court recognized this grievance, directing the state to expedite the restructuring of service rules to ensure state-wide seniority and equitable promotions.


The court has ordered the state government to frame and notify new service rules for Telangana State Special Police Battalions within six months, ensuring alignment with the Presidential Order. Additionally, the petitioner’s seniority representation is to be reconsidered, potentially granting him consequential benefits.


This judgment underscores the judiciary's role in upholding constitutional mandates and rectifying administrative inconsistencies, ensuring that service rules align with statutory and constitutional provisions.
