Court Overturns Government's Denial of Surrogacy Certification, Upholds Right to Parenthood for Woman with CAIS


In a landmark judgment, the Telangana High Court has directed the issuance of the Certificate of Essentiality and Eligibility for surrogacy to a woman suffering from Complete Androgen Insensitivity Syndrome (CAIS), asserting her right to parenthood under the Surrogacy (Regulation) Act, 2021. The court set aside the order of the Commissioner, Health & Family Welfare, which had earlier denied the certificate based on the woman's chromosomal disorder, indicating a 46 XY karyotype.


The petitioners, Dr. M and her husband, had approached the court after their application for surrogacy was rejected by the State Appropriate Authority, citing the woman's genetic profile which did not fit the traditional definition of a "woman" as per the Act. The court, however, found this reasoning flawed and contrary to the intent of the legislation, which aims to assist infertile couples.


Justice Nagesh Bheemapaka, presiding over the case, underscored that the Surrogacy (Regulation) Act, 2021, is intended to alleviate the hardships faced by couples unable to conceive naturally. The Act, according to the court, is designed to be inclusive, providing a legal framework for those like Dr. M who have medical indications necessitating surrogacy.


The High Court emphasized that the denial of the certificate violated Article 21 of the Indian Constitution, which guarantees the right to life, including the right to parenthood. The court criticized the State Appropriate Authority's reliance on a narrow interpretation of genetic criteria, stating that it overlooked the broader purpose of the Act and the scientific understanding of gender and sex.


The court's decision reflects a significant step towards recognizing the rights of individuals with intersex variations. It acknowledges the scientific consensus that gender identity and expression are complex and cannot be strictly categorized based on chromosomes alone.


In its judgment, the court referenced similar cases, including a Supreme Court decision that highlighted the importance of the woman's condition in determining eligibility for surrogacy, irrespective of chromosomal anomalies. The court reiterated that the Surrogacy Act is woman-centric and should prioritize the medical or congenital conditions preventing a woman from achieving motherhood.


The ruling mandates the State Appropriate Authority to issue the necessary certificates to the petitioners, enabling them to proceed with surrogacy. This verdict is expected to have far-reaching implications for future cases involving surrogacy and reproductive rights in India.
