Telangana High Court Orders Transfer of Police Suicide Investigation to CBCID

Concerns over biased investigation prompt court to ensure fair probe into allegations against senior police officer


In a significant move to uphold the principles of justice and impartiality, the Telangana High Court has directed the transfer of the investigation into the alleged suicide of a Sub-Inspector of Police to the Crime Branch Crime Investigation Department (CBCID). The decision follows concerns raised by the petitioners regarding the fairness and credibility of the local police investigation, which accused a senior police officer of harassment, abetment of suicide, and tampering with evidence.


The case involves the tragic death of P. Prabhakar Reddy, who reportedly shot himself with his service revolver at the Police Headquarters in Siddipet District. The petitioners, including the deceased's wife and mother, alleged that the Assistant Commissioner of Police (ACP) Gajwel had pressured the deceased into illegal activities, leading to severe mental distress and ultimately his suicide. They further claimed that the ACP manipulated the crime scene by removing a crucial suicide note and valuables from the body.


Despite registering a case under Section 306 of the IPC, the investigation conducted by the local police was criticized for lacking impartiality, with allegations of collusion to protect the accused officer. The petitioners argued that this biased approach violated their fundamental rights under Article 21 of the Constitution, which guarantees the right to a fair and impartial investigation.


Considering the grave allegations and the potential for bias, the High Court, presided by Justice N. Tukaramji, emphasized that justice must be perceived to be done and ordered the transfer of the case to CBCID. The court underscored the necessity of an independent agency to scrutinize the allegations thoroughly, ensuring public confidence in the investigative process.


The CBCID has been tasked with conducting a comprehensive investigation, examining all aspects, including the alleged abetment of suicide, tampering of evidence, and removal of valuables. The court mandated that the investigation be completed expeditiously, with progress reports submitted periodically to the jurisdictional Magistrate.


This judgment reinforces the judicial commitment to safeguarding citizens' rights by ensuring that investigations into alleged misconduct by police officials are conducted with the utmost integrity and transparency. The transfer to CBCID aims to dispel any reasonable apprehension of bias and uphold the constitutional mandate of fairness in the criminal justice system.
