In a significant judgment, the Telangana High Court, presided over by Justice Surepalli Nanda, dismissed the writ petition filed by the Telangana Small Scale Industries Steel and Wooden Furniture Manufacturers Association, challenging the supplementary agreements entered by the State of Telangana concerning the tender for supplying bunker beds to Kasturba Gandhi Balika Vidyalayas (KGBVs). The petitioners had alleged that the supplementary agreements were illegal and arbitrary, contravening original tender conditions.


The court ruled that judicial review of tender processes is limited and can only intervene in cases of arbitrariness, malafides, bias, or irrationality. Justice Nanda emphasized that the tendering authority possesses the discretion to interpret its tender documents and extend contract completion time when justified. The decision to execute supplementary agreements was deemed permissible as the tender documents allowed such extensions, and the tender process was conducted fairly with adherence to established norms.


The court also addressed the petitioners' claims regarding the eligibility criteria, noting that authorized dealers of Original Equipment Manufacturers (OEMs) were rightly considered based on OEMs' eligibility. The petitioners lacked locus standi to challenge the tender as they did not participate in the process, affirming that non-participants cannot seek judicial review to protect private interests.


Responding to the petitioners' claims of favoritism and exorbitant pricing, the court found no evidence supporting these allegations. The tender process, including the execution of supplementary agreements, was conducted transparently, with necessary approvals and adjustments made in the public interest.


This judgment reiterates the principles of restraint in judicial review concerning administrative decisions, emphasizing the expertise of tendering authorities in managing tender processes. The court's decision is expected to streamline the procurement process for KGBVs, ensuring timely delivery of essential infrastructure.
