Telangana High Court Upholds Tribunal's Award in Motor Accident Case, Modifies Interest Rate

Compensation of Rs. 10.4 Lakhs Affirmed, Interest Rate Reduced from 9% to 7.5% per Annum


 In a significant judgment, the Telangana High Court, presided over by Justice C.V. Bhaskar Reddy, upheld the Motor Accidents Claims Tribunal's award of Rs. 10,40,405 to the dependents of Ilaiah Yadav, who died in a road accident. The accident was attributed to the rash and negligent driving of a DCM vehicle. However, the court modified the interest rate on the compensation from 9% to 7.5% per annum, aligning with the Supreme Court's precedent in similar cases.


The case stemmed from an accident on March 23, 2015, when the deceased, Ilaiah Yadav, was fatally injured after being hit by a DCM vehicle while riding his motorcycle. The claimants, including Yadav's wife, children, and parents, sought compensation, asserting dependency on his income. The Tribunal had initially awarded the compensation based on the deceased's monthly income, future prospects, and appropriate deductions, applying the principles from landmark Supreme Court judgments.


The appellant, United India Insurance Co. Ltd., challenged the Tribunal's findings, arguing contributory negligence and policy violations due to the driver's lack of a valid license. However, the High Court found no merit in these claims, noting the absence of substantial evidence from the Insurance Company to counter the Tribunal's findings. The High Court reiterated the Tribunal's conclusion that the accident was solely due to the DCM driver's negligence.


While the compensation amount was deemed just and reasonable, the High Court agreed with the appellant regarding the interest rate, citing the Supreme Court's decision in National Insurance Company Ltd. v. Mannat Johal, which established 7.5% as the standard interest rate for such cases. Consequently, the interest rate was adjusted, but the compensation award remained unchanged.


The judgment reinforces the judicial approach to motor accident compensation, ensuring fair recompense for victims' families while adhering to established legal standards for interest rates.
