Tribunal orders Rs 30.44 lakh compensation to kin of man killed in 2022 road accident

Thane, May 17 The Motor Accident Claims Tribunal in Maharashtra’s Thane has awarded a compensation of Rs 30.44 lakh to the family of a 37-year-old man killed in a road accident in 2022.


In its order of May 11, a copy of which was made available on Sunday, the tribunal directed an insurance company to release the amount to the claimants first and subsequently recover it from the party at fault.


Victim Hazrat Ali Ishtiyak Ahmad, a driver, was hit by a motorcycle while walking along the Bhiwandi-Wada road on July 11, 2022. He succumbed to his injuries the next day.


Advocate UR Vishwakarma appeared for Ahmad’s family, while Advocate HG Patil represented the owner of the vehicle. The insurance company was represented by Advocate KV Poojari.


The insurer claimed pedestrian negligence, but the tribunal dismissed the argument, noting that no evidence of contributory negligence on the part of the deceased was presented to it.


Citing Supreme Court precedents, Tribunal Member R V Mohite directed that the insurance company must first compensate the victim’s kin and then seek recovery from the vehicle owner.


The tribunal awarded compensation of Rs 30.44 lakh, considering the victim's monthly salary of Rs 15,000, his age, and the number of dependents.
