New Delhi, Jun 23 A motor accident claims tribunal here has directed that Rs 44.69 lakh compensation be paid to a 47-year-old man whose leg had to be amputated due to grievous injuries sustained in a road accident in 2020.
Presiding officer Shirish Aggarwal was hearing the petition of the injured, Sanjay, who said that he was waiting in his e-rickshaw in Delhi Cantt when a car driving rashly and negligently hit his vehicle on February 12, 2020.
In an order dated June 8, the tribunal said during the final arguments, counsel for United India Insurance Company Ltd submitted that it is not in dispute that compensation had to be paid to the petitioner, it only had to decide the quantum of compensation.
It said that in view of the submissions of the insurance company, the petitioner was entitled to be compensated for the injuries suffered by him in the accident.
The tribunal said that the petitioner had to be compensated for pecuniary damages, such as expenses related to treatment, hospitalisation, medicines, transportation and other miscellaneous expenditure.
He would also be compensated for loss of earnings, including loss of earnings during treatment, loss of future earnings on account of permanent disability and future medical expenses.
Compensation for non-pecuniary or general damages, such as damages for pain, suffering and trauma, loss of amenities and loss of expectation of life would also have to be paid, it said.
The tribunal also noted that the petitioner’s right lower limb below his knee had been amputated and has to now live with 60 per cent physical disability.
It directed the insurance company to provide over Rs 44.69 lakh compensation under various heads.
