The case in question involved two minors, both approximately 15 years old, where allegations of kidnapping and consensual physical relations were brought forth.


Presiding over the case, Justice Alok Mahra highlighted the importance of balancing the protection of minors with the recognition of their autonomy in certain contexts. The court was presented with a situation where the victim, in her statement recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023, admitted to consensual physical relations with the applicant. The medical examination supported this by revealing no evidence of forceful sexual intercourse.


Advocates for the applicant, including Mrs. Snigdha Tiwari and Mr. Abhijay Negi, argued that maintaining the applicant, a minor, in an Observation Home as a child in conflict with law could have adverse effects on his future. They emphasized the longstanding friendship between the applicant and the victim, suggesting that leniency be exercised given the consensual nature of the relationship and their young age.


The court referred to a precedent set by the Supreme Court in the case of State of Uttar Pradesh v. Anurudh, which stressed the importance of recognizing consensual adolescent relationships to prevent wrongful imprisonment and other unjust outcomes. The Uttarakhand High Court echoed this sentiment, noting that the judicial system should aim to protect minors while acknowledging their ability to make autonomous decisions in certain situations.


In light of the arguments presented and the supporting evidence, the court directed a stay on further proceedings in the pending criminal case against the applicant until the next hearing date. This interim order reflects the court's cautious approach in handling sensitive cases involving adolescents, ensuring that justice is served without compromising the future of young individuals.


The case will be revisited following the receipt of a service report, with the court aiming to deliver a balanced judgment that respects both the legal framework and the nuanced realities of adolescent interactions.
