Court Emphasizes Custodial Protection Citing Serious Allegations and Victim's Age in POCSO Case


In a significant ruling, the Uttarakhand High Court, presided over by Justice Alok Mahra, has denied the bail application of Shubha, the petitioner involved in a case concerning the repeated sexual exploitation of a minor girl. The decision was pronounced on May 6, 2026, in the backdrop of grave allegations that have serious implications for the moral and physical integrity of the child involved.


The case stems from an FIR registered under various sections of the Bharatiya Nyaya Sanhita, 2023, and the Protection of Children from Sexual Offences (POCSO) Act, 2012. The allegations involve the victim's mother coercing her daughter, a minor, to engage in sexual activities with the petitioner and another co-accused across multiple locations, including Haridwar, Agra, Ghaziabad, and Vrindavan. The victim, who was 13 years old at the time, reportedly also consumed intoxicating substances during these incidents.


The counsel for the petitioner, Mr. Aditya Singh, argued that the charges were unfounded and that the FIR was a fabrication. He highlighted inconsistencies in the prosecution's story, such as the improbability of the mother having access to the victim at her residential school and the delay in filing the FIR. However, these arguments were not sufficient to sway the court.


Opposing the bail, the State Counsel, Mr. Prabhat Kandpal, and the complainant's advocate, Mr. B.M. Pingal, underscored the seriousness of the allegations and the consistency of the victim's statements under the Bharatiya Nyaya Sanhita. They stressed that the victim's testimony, corroborated by other witnesses, established a prima facie case against the petitioner, justifying the need for custodial protection to prevent any potential influence on witnesses.


Justice Mahra, upon reviewing the submissions and the case records, emphasized the gravity of the allegations, the vulnerability of the minor victim, and the potential risks involved in granting bail. He noted that prolonged custody alone does not justify bail in such serious cases, especially when the integrity of the trial could be compromised.


The court's decision reflects a cautious approach, prioritizing the protection of the victim and the integrity of the judicial process over the petitioner's plea for bail. This judgment sets a precedent in handling cases involving severe allegations under the POCSO Act, reinforcing the judicial system's commitment to safeguarding minors.
