Court mandates objective verification of disputed signatures before cancellation; orders reinstatement of dealership


In a significant ruling, the Uttarakhand High Court has set aside the cancellation of a fair price shop dealership of Vinod Kumar in Haridwar, emphasizing the necessity of obtaining expert opinion or conducting objective verification of disputed signatures before reaching conclusions on allegations of forgery. The judgment, delivered by Justice Pankaj Purohit, underscores the serious civil and criminal consequences that such allegations carry, necessitating a thorough and unbiased examination.


The petitioner, Vinod Kumar, challenged the orders cancelling his dealership, arguing that the allegations of forgery were baseless and had been made without any objective verification. The court noted that the allegations originated from a Gram Sabha resolution recommending the cancellation of his dealership due to purported irregularities in distribution and alleged forgery of signatures on stock registers and consumption certificates.


The court observed that the inquiry report, which formed the basis for the cancellation by the District Magistrate, had concluded discrepancies in the signatures without obtaining any handwriting expert opinion or scientific examination. It was noted that the Panchayat Secretary's mere denial of signatures was insufficient proof of forgery.


Justice Purohit highlighted the need for concrete evidence when allegations involve forgery, which can lead to severe consequences. The court found that the authorities had not undertaken any proper verification or comparison of the signatures and concluded that the findings of forgery were based on assumptions rather than objective analysis.


The court also addressed procedural concerns regarding the Gram Sabha resolution, which failed to meet statutory quorum requirements as per the Uttarakhand Panchayati Raj Act, 2016. It was held that recommendations made without fulfilling these requirements could not be acted upon.


The High Court quashed the orders dated September 6, 2021, by the District Magistrate, Haridwar, and March 21, 2022, by the Commissioner, Garhwal Division, Dehradun, and directed the restoration of Vinod Kumar's fair price shop dealership, allowing him to resume operations.


The judgment serves as a reminder to authorities to adhere to procedural fairness and ensure objective investigations in administrative actions involving serious allegations, thereby safeguarding individuals' rights against arbitrary decisions.


Bottom line:-

Fair price shop dealership cannot be cancelled solely on the basis of allegations of forgery without obtaining expert opinion or conducting objective verification of disputed signatures.
