In a significant verdict, the Supreme Court of India dismissed the appeals filed by UCO Bank against its employee SK Shrivastava, thereby upholding the High Court of Chhattisgarh's decision which granted terminal benefits to Shrivastava. The apex court ruled that voluntary retirement, as per UCO Bank (Employees') Pension Regulations, 1995, becomes effective automatically if not expressly refused within the notice period.


The case revolved around Shrivastava, who had submitted a notice for voluntary retirement on October 4, 2010. According to the Pension Regulations, such a notice required acceptance by the appointing authority unless refused within the prescribed three-month notice period. UCO Bank, however, failed to communicate any refusal within this timeframe, thus rendering the retirement effective as of January 4, 2011.


The Supreme Court, with Justices J.K. Maheshwari and Vijay Bishnoi presiding, emphasized that issuing a show-cause notice does not equate to the institution of disciplinary proceedings. The court further clarified that the show-cause notice issued to Shrivastava did not imply any intention to initiate such proceedings, nor did it serve as a valid ground to negate the voluntary retirement notice.


The ruling also quashed UCO Bank's subsequent actions, including the issuance of a chargesheet and the dismissal order against Shrivastava, as these were deemed legally unsustainable following his effective retirement. The court directed UCO Bank to settle all post-retiral benefits due to Shrivastava within three months, along with applicable interest.


This judgment underscores the importance of timely communication by employers regarding voluntary retirement notices and delineates the conditions under which disciplinary proceedings can affect such retirements. It sets a precedent for similar cases, emphasizing the necessity of a positive refusal by the appointing authority within the notice period to prevent automatic retirement.
