Delhi High Court Grants Injunction Against Rogue Websites for Copyright Infringement

News Report:

In a significant judgment, the Delhi High Court has granted an ex-parte ad-interim injunction against several rogue websites involved in the unauthorized streaming and dissemination of Jiostar India Private Limited’s upcoming film 'Jolly LLB 3'. The judgment, delivered by Justice Tejas Karia on September 12, 2025, aims to protect the intellectual property rights of the plaintiff, a leading media production and distribution company.

The case, titled Jiostar India Private Limited v. Vegamovies.Yachts & Ors, involved allegations of copyright infringement against websites that were illegally hosting and streaming the film, slated for release on September 19, 2025. The court ordered Defendant Nos. 1 to 24 to cease hosting, streaming, or making available the film 'Jolly LLB 3' without authorization. Furthermore, Domain Name Registrars (DNRs) and Internet Service Providers (ISPs) were directed to block access to these websites to prevent further infringement.

In a proactive move, the court upheld the doctrine of 'Dynamic+' Injunction, which extends protection to future works, allowing the plaintiff to notify newly identified rogue websites for immediate blocking without the need for repeated court interventions. This measure addresses the evolving piracy tactics that threaten the plaintiff’s financial interests and intellectual property rights.

The court emphasized the balance of convenience and irreparable harm, noting the potential financial losses and copyright violations the plaintiff could face if unauthorized dissemination occurred. The judgment highlighted the necessity for swift action to prevent the alleged infringements, ensuring that the plaintiff's rights are protected before the film's release.

The court's directive also included detailed instructions for DNRs and ISPs to furnish information about the infringing websites and to take necessary steps for their deactivation. Additionally, government authorities were instructed to issue notifications to block access to these domains.

This landmark judgment underscores the judiciary's commitment to safeguarding intellectual property rights in the digital age, setting a precedent for similar cases involving copyright infringement by rogue websites.
