Kolkata, Jul 14 A division bench of the Calcutta High Court will on Wednesday continue hearing of an appeal by TMC MLA Sovandeb Chattopadhyay, challenging a single bench's refusal to pass an interim order on the West Bengal Assembly Speaker's decision to appoint breakaway faction MLA Ritabrata Banerjee as the Leader of Opposition.
Banerjee's lawyer made submissions before the division bench comprising Justices Shampa Sarkar and Ajay Kumar Gupta, stating that the appointment was made in adherence to the 10th schedule of the Constitution, which constitutes the anti-defection law.
The court said that the submissions in the matter would continue on Wednesday.
A single bench of the high court had refused any interim order on June 18 regarding West Bengal Assembly Speaker Rathindra Bose's decision to appoint breakaway TMC group MLA Ritabrata Banerjee as the Leader of Opposition, and fixed July 28 for further hearing.
Chattopadhyay, belonging to the Mamata Banerjee-led TMC faction, moved the high court challenging the rejection of his name and the appointment of Banerjee as the LoP.
