Directions Issued for Investigation, Interim Compensation, and Care of Victim's Minor Children
In a significant move, the Supreme Court of India has taken suo moto cognizance of a brutal assault on a woman advocate, marking an urgent call for judicial intervention. The case, titled "In Re: Brutal Assault On A Member of The Legal Fraternity and Need For Judicial Intervention," was heard by a bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi.
The court was prompted to act following a letter dated April 25, 2026, from Ms. Sneha Kalita, an Advocate on Record at the Supreme Court, seeking urgent intervention in the case. The letter highlighted the need for immediate action against the accused and called for compensation under the National Legal Services Authority’s Victim Compensation Scheme.
During the proceedings, it was revealed that the victim's husband, alleged to be the prime accused, has already been arrested, but the in-laws remain absconding. In a distressing turn, two minor daughters of the victim were taken away by the accused's parents, while the eldest daughter is in the care of maternal grandparents.
Recognizing the gravity of the situation, the Supreme Court issued several interim directions. The Delhi Police has been instructed to transfer the investigation to a senior officer, preferably a woman, to ensure a thorough and sensitive probe. Additionally, the court directed the authorities to locate the missing children and maintain the eldest child's custody with her maternal family.
The court also addressed the victim's urgent need for medical and financial support. Despite being denied admission by multiple hospitals, she eventually received treatment at AIIMS Trauma Centre. In light of her condition and financial distress, the National Legal Services Authority has been ordered to release an interim compensation of Rs. 3 lakhs to aid in her treatment and care for her children.
The Supreme Court has underscored the importance of a fair investigation, ensuring that no involved party evades justice. The matter is set to be revisited on May 11, 2026, with the court expecting a status report on the investigation and the victim's medical care.
