Court Upholds Applicant's Right to Passport Renewal, Directs Ministry of External Affairs to Ensure Compliance


In a significant ruling, the Allahabad High Court has directed the renewal of a passport for an applicant, Dilip, whose application was previously rejected by the Additional Chief Judicial Magistrate, Rampur. The court noted that the renewal of a passport is a legitimate right of the applicant and cannot be denied based on mere apprehensions or fears raised by the prosecution.


The case arose when Dilip, currently residing in Saudi Arabia, sought the renewal of his passport to return to India and appear before the court in connection with a pending criminal case. The Additional Chief Judicial Magistrate had earlier denied the renewal on the grounds of insufficient details, such as the passport expiry date and number, in the application.


However, Justice Saurabh Srivastava, presiding over the matter, observed that the refusal to renew the passport was unjustified. The court emphasized that the legitimate right of the applicant to passport renewal cannot be curtailed merely due to the prosecution's concerns about his return to India. The court further directed the Ministry of External Affairs and the Regional Passport Officer to ensure the renewal of Dilip's passport without delay, provided there are no other legal impediments.


The court also instructed the Ministry of External Affairs to coordinate with the Indian Embassy in Saudi Arabia to facilitate Dilip's appearance before the concerned court, in compliance with the non-bailable warrants issued against him.


This ruling underscores the judiciary's commitment to upholding individual rights while balancing the concerns of law enforcement agencies.
