Court Suggests Apology to Resolve Long-standing Dispute Among Elderly Litigants, Case Adjourned for Further Consideration


In a significant observation concerning the ongoing defamation suit between Tarinibahen Desai and Kilkilraj Bhansali, the Bombay High Court highlighted the detrimental impact of ego conflicts on court proceedings, especially involving senior citizens. Presided over by Justice Jitendra Jain, the court underscored the need for resolution through an unconditional apology, which could serve as a pragmatic approach to alleviate the burden on the judicial system.


The case, Suit No. 7 of 2017, was brought before the court by Tarinibahen Desai and another plaintiff against Kilkilraj Bhansali and several other defendants. Despite the court's suggestion to resolve the matter amicably with an apology, the nonagenarian plaintiff, Tarinibahen Desai, remained adamant about pursuing the defamation suit to its conclusion.


Justice Jain remarked on the importance of prioritizing cases that demand urgent attention and noted that ego clashes often impede the judicial process, even at the twilight of the litigants' lives. The court expressed its concern that such disputes could be resolved outside the courtroom, thereby allowing the judiciary to focus on more pressing matters.


Given the plaintiffs' insistence on continuing the litigation, the court adjourned the case to July 15, 2026, for further consideration. The adjournment provides a window for reflection and possible reconciliation between the parties, as the court continues to encourage an out-of-court settlement.


The legal representatives for both parties, including Mr. Sanskruti Yagnik for the plaintiffs, and Mr. Pushkraj Deshpande, alongside Ms. Anushtha Rathod for several defendants, were present during the proceedings. Mr. Nilesh Parte represented another defendant.


This case not only brings to light the personal conflicts that can arise during litigation but also emphasizes the broader implications on the legal system, urging a cultural shift towards amicable resolutions wherever possible.
