Choubey has been in custody since November 2025 in connection with the case registered at Hazaribagh Anti-Corruption Bureau (ACB) under multiple sections of the Indian Penal Code (IPC) and the Prevention of Corruption (Amendment) Act, 1988. The allegations against him involve the unauthorized mutation of gairmazurwa khas jungle land in favor of individuals known to him, alongside the layering of illicit money through associated entities.


The court reviewed the evidence presented, which included statements from subordinate officials implicating Choubey. Notably, Circle Officer Alka Kumari testified that the land mutation was carried out under Choubey's instructions, despite objections regarding the nature of the land. This testimony was corroborated by other officials who reported similar pressures to conduct illegal activities.


The prosecution argued that Choubey, during his tenure as Deputy Commissioner, facilitated the mutation of land under illegitimate circumstances and engaged in financial activities that did not align with his income levels. The investigation revealed that significant amounts of money were funneled through companies associated with Choubey’s family, including Brahmhastra Education Private Ltd., where substantial deposits were made between 2010 and 2015.


Despite the defense's argument citing the Supreme Court's grant of bail to co-accused Binay Kumar Singh in a related case, the High Court remained unconvinced. The court highlighted the gravity of the accusations and the likelihood of Choubey influencing ongoing investigations and witnesses if released on bail.


This decision underscores the judiciary's stance on maintaining the integrity of the investigative process in cases involving public corruption and the misuse of official authority. As the legal proceedings continue, the focus remains on ensuring a comprehensive examination of the alleged misconduct.
