Calcutta High Court Issues Stricter Controls on Firecracker Use During "Shab-e-Barat"

Directions Mandated for Pollution Control Board and Police to Curb Environmental Hazards

In a significant ruling, the Calcutta High Court has mandated rigorous controls on the use of firecrackers during the "Shab-e-Barat" festival to mitigate environmental hazards. The Division Bench, comprising Chief Justice Sujoy Paul and Justice Partha Sarathi Sen, issued directives to ensure that no illegal or hazardous firecrackers are used, and established a time frame for their permissible use.

The case was brought forward by Miss Shagufta Sulaiman, who appeared in person, expressing concern over the irregular and potentially harmful use of firecrackers during the festival. The petitioner sought intervention to prevent environmental degradation and personal safety risks associated with the festivities.

The court directed the Pollution Control Board and police authorities to enforce strict compliance with environmental regulations. Specifically, the judgment prohibits the use of firecrackers between 10:00 p.m. and 6:00 a.m., reflecting the court's commitment to addressing noise and air pollution during nighttime hours.

Moreover, the court underscored the importance of personal security, instructing the police department to provide adequate protection to Miss Sulaiman and her family throughout the festival period. This directive highlights the court's recognition of individual safety alongside environmental concerns.

The absence of representation from the Pollution Control Board was noted, and the court emphasized the necessity of their involvement in enforcing these measures. An action-taken report is to be submitted before the next hearing scheduled for April 2026, ensuring compliance and accountability.

The state counsel, Mr. Amal Kr. Sen, has been tasked with promptly communicating this order to relevant authorities, reinforcing the urgency and significance of the court's directives.

This judgment marks a proactive step by the judiciary in addressing environmental and safety concerns associated with cultural festivities, setting a precedent for similar interventions in the future.

Bottom Line:

Directions issued to ensure prevention of irregular and hazardous bursting of firecrackers during "Shab-e-Barat" and to fix a time limit for their use.

Statutory provision(s): Environmental Protection Act.
