Tribunal Clarifies GPS Requirement Extends to Both Groundwater and Treated STP Water Tankers


In a significant development aimed at curbing illegal groundwater extraction in Delhi, the National Green Tribunal (NGT) has reiterated and clarified its earlier directive mandating GPS installation in all water tankers operating for commercial purposes in the city. This decision comes as a response to ongoing concerns about unauthorized groundwater extraction and transportation, which has been a persistent issue in the National Capital Territory.


The judgment, delivered by a bench comprising Judicial Member Arun Kumar Tyagi and Expert Member Dr. Afroz Ahmad, emphasized the necessity of installing GPS systems in tankers transporting both groundwater and treated Sewage Treatment Plant (STP) water. This clarification was made following applications filed by intervenors Satnam Singh and Anurag Dua, who faced legal actions despite transporting treated STP water.


The Tribunal's decision underscores that the mandate is not limited to tankers carrying groundwater alone but extends to those transporting STP-treated water to ensure comprehensive monitoring and prevent potential misuse. The Tribunal has directed the Delhi Jal Board (DJB) and tanker owners to comply strictly with these requirements, maintaining proper records and ensuring that all tankers are equipped with GPS.


The Tribunal has also issued additional directives to bridge gaps in the current monitoring system. These include issuing gate passes and transit passes in duplicate, maintaining detailed records of tanker movements, and ensuring that all relevant documentation is carried by tanker drivers during transportation.


Failure to comply with these directives could result in legal action under the National Green Tribunal Act, the Bharatiya Nyaya Sanhita, and the Environment (Protection) Act. The Tribunal's order is seen as a crucial step towards promoting sustainable water management practices in Delhi, aligning with national policies on water conservation and environmental protection.


The judgment has been communicated to the Chief Secretary of the Government of the National Capital Territory of Delhi, the CEO of the Delhi Jal Board, and the Commissioner of Police, Delhi, for immediate implementation and compliance.
